The liberalisation of rail transport began with EU Directive 91/440 and has continued in stages. From 2006, the entire cross-border rail freight transport throughout the European Union will be liberalised.

Current regulations still differ widely - depending on each country’s national legislation.

When considering whether transport services can be offered abroad, we must make a distinction between two fundamental aspects:

  • right of establishment, i.e. the right to establish a railway undertaking in another country. 
  • network access right, i.e. the right to acquire access to another country’s rail infrastructure.
